These Terms of Use govern the use of the Evo Play Smart TV application and the website https://evoplay.tv (together, the "Service"), provided by [PREENCHER], registration number (CNPJ) [PREENCHER], located at [PREENCHER]. By installing the application, adding a playlist or purchasing an activation, you agree to these terms.
1. What the Service is
Evo Play is a media player. It lets you open, on your TV, playlists that you add yourself: Xtream accounts, M3U links, M3U files and video links.
Evo Play does not provide, sell, host, recommend or distribute any content, such as channels, movies, series or playlists. Our servers only store the access details of the playlists you add. They never access, store or relay the content of those lists.
2. Your responsibility for content
- You confirm that you will only use playlists from sources that have the right to offer that content, and that you respect copyright laws.
- You are solely responsible for the playlists you add and for what you watch with them.
- We do not monitor users' playlists. If we receive a substantiated notice of unlawful use, we may block the device involved and cooperate with the authorities, as required by law.
3. Device, MAC and key
The first time it opens, the application generates a MAC address and a 6-digit key for your TV. The MAC and key give access to managing that device's playlists on the website. Keep the key safe and do not share it. For security, we temporarily block attempts after repeated errors.
4. Free trial, activation and payments
- Each new device gets a 7-day free trial, counted from the first time the application opens.
- After the trial, use depends on activating the device with an annual or lifetime plan, paid on the website or done by an authorized reseller. An activation covers a single device (one MAC).
- "Lifetime" means for as long as the Service is operated, for that device.
- Payments are processed by payment providers (such as Mercado Pago). We do not receive or store your card details.
- You may cancel a purchase within 7 days, as provided by article 49 of the Brazilian Consumer Protection Code, through the contact page.
- An activation does not include any content. Problems with your playlist, such as an expired, offline or blocked account, are your provider's responsibility, not Evo Play's.
5. Resellers
Approved resellers may activate devices using credits bought from us. Resellers have no access to the playlists of the devices they activate and may not offer content on behalf of Evo Play.
6. Prohibited use
- Trying to access other people's devices or playlists, guessing keys or bypassing security limits.
- Reverse engineering, copying or redistributing the application, except as permitted by law.
- Using the Service to distribute content without authorization from the rights holders.
7. Suspension and blocking
We may suspend or block a device that violates these terms, shows signs of fraud (for example, a payment chargeback) or by court order. Whenever possible, we show the reason on the TV itself.
8. Availability
We work to keep the Service stable, but we do not guarantee uninterrupted operation or compatibility with every TV model. Updates may change application features.
9. Intellectual property
The application, the website, the Evo Play brand and its design belong to [PREENCHER]. Using the Service does not transfer any of these rights to you.
10. Limitation of liability
To the extent permitted by law, we are not liable for the content of third-party playlists, for the availability of playlist providers or for indirect damages arising from the use of the Service.
11. Privacy
Personal data is handled according to our Privacy policy and Cookie policy.
12. Changes
We may update these terms. The current version is always on this page, with the date of the last update. Relevant changes are announced on the website or in the application.
13. Governing law
These terms are governed by the laws of Brazil. The courts of the consumer's place of residence have jurisdiction.
